Creativity — Terms of Use
In short — what this site is, and who you buy from
“Creativity” is the name this platform is run under. It is a brand, not a company: the platform is operated by Thomas Doykinitsas, a sole trader, and every reference to Creativity, “we”, “us” or “our” on this page means that trader. Everything in Creativity’s own catalogue — our films, series, backstage material and music — is free to watch, and always will be.
Some titles on this site come from independent partner studios. They are marked with the partner’s own channel logo and a clear price to rent or buy. When you rent or buy one of those, you are buying from the partner, not from Creativity. The partner is the seller: they take the payment, they issue the receipt in their own name with their own tax number, and the obligations of a seller are theirs.
Creativity provides the platform, the hosting, the streaming and the support, and takes a commission from the partner. This page is our platform terms — what we do and what we are answerable for. The seller is named at checkout and on your invoice.
1. These terms
These terms govern your use of creativityfilms.gr, its television and casting apps and everything they serve (together, “the platform”). By using the platform you agree to them. If you do not agree, please do not use the platform. The platform is operated by the trader named at the end of these terms. Where you rent or buy a partner title, the sale itself is governed by the section “Buying on Creativity” below and by the seller’s own terms.
2. Accounts
Signing in uses your Google account. You are responsible for keeping that account secure and for everything done through it on the platform. You must be at least 16 years old to create an account; younger viewers may use the free catalogue without one, with a parent or guardian’s consent.
Creativity+ is a YouTube channel membership. We read your membership status from YouTube to unlock member content; we do not sell it and cannot refund it. Attempting to bypass YouTube’s restrictions or our membership checks is a breach of these terms.
3. Intellectual property
Creativity’s own films, series, music, games, artwork, text and code are owned by Creativity or its contributors and are protected by copyright and related rights. Partner titles are owned by the partner that supplies them. You may stream content for your own personal, non-commercial viewing; you may not download (except where a download button is provided), copy, record, redistribute, publicly perform, reverse-engineer or circumvent any technical protection on any content, and you may not scrape or bulk-access the platform.
4. Acceptable use
You agree not to use the platform in a way that damages it, interferes with other viewers, gains access you are not entitled to, or breaks any law. You may not automate access to the platform, probe or overload it, or use it to distribute anything unlawful, defamatory or infringing. Where the platform lets you post reactions or other material, you are responsible for what you post and grant us a licence to display it on the platform.
How recommendations are chosen
Where you see a "More like this" row, the titles in it are chosen by comparing editorial tags — descriptive scores our team assigns to each work, such as how funny, scary or fast-paced it is. Titles whose scores are closest to the one you are looking at appear first, the same way for every visitor. Where a title has not been scored yet, we fall back to showing other titles in the same category.
If you are signed in, you may also see a "For you" row on your home page. Unlike "More like this", this one is personal: it is built from your own likes, dislikes and reactions, not from the title you happen to be looking at. It never replaces the rows we curate by hand — it is an extra row, and you can turn it off at any time from your account settings. The homepage and every other row on the site are arranged by us by hand. No third party pays for placement in these rows, and nothing on the site is reordered by a profile of you except the optional, opt-out-able "For you" row described above.
5. Suspension and termination
We may suspend or close your account, with notice where reasonably possible, if you breach these terms, if we are required to by law or by Google, or if the platform or a feature is discontinued. You may close your account at any time from your profile menu (“Revoke access”), which deletes your data as described in the Privacy Policy. Closing your account ends any rental in progress; purchases can only be accessed through the account that made them.
6. Our liability — free content
The platform — Creativity’s own catalogue, the site and its apps — is provided free of charge, “as is” and “as available”. To the fullest extent the law allows, we give no warranty that it will be uninterrupted, secure, error-free, available at any particular time, or suitable for any particular purpose, and we accept no liability for loss arising from your use of the free service, including loss of watch history or preferences. The liability section under “Buying on Creativity” and the non-excludable-liability carve-out apply to everything on this page.
7. Third-party services
The platform relies on services we do not control: Google for sign-in, YouTube for memberships and some video, Stripe for payments, and content-delivery and hosting providers. Their terms apply to your use of them, and we are not responsible for their availability or conduct. Links to other sites are provided for convenience only.
8. Changes to these terms
We may update these terms from time to time — for example when a feature is added or the law changes. The current version is always at this address with its effective date. Material changes will be announced on the platform, and if you continue to use it after they take effect you accept them. Changes do not apply retrospectively to a purchase you have already made.
9. Governing law and disputes
These terms are governed by the law of England and Wales, and the courts of England and Wales have non-exclusive jurisdiction. If you have a problem, please write to us first — most things can be sorted out by email.
If you are a consumer living in the European Union or elsewhere, nothing in this section takes away the protection of the mandatory consumer laws of the country where you live, and you may bring a claim in the courts of that country. For a purchase, your contract is with the seller named on your invoice, and your rights against them are unaffected by these terms.
Buying on Creativity
What Creativity is, what partners are
Creativity is a hosting platform. We publish our own productions and we host titles supplied by partner studios. A partner’s title always carries that partner’s channel attribution; it is never presented as a Creativity production.
We are not the author, producer or rights-holder of partner content, and we do not vet it for legal compliance on your behalf. We do look at what we publish, because we care what is on the site — doing so does not make us the author of it. Partners warrant to us that they hold the rights to what they supply and remain responsible for it.
If you believe something here is illegal or infringes your rights, tell us through the content report form. We act on valid notices, and where a partner’s title is involved we may suspend it while the matter is resolved.
Paid partner titles — what you get, and from whom
A paid title always shows a specific price and either “Rent” or “Buy”. There is never a play button that turns into a paywall. Prices are shown in euro and include any VAT the seller has to charge.
The seller is the partner named at checkout and on your invoice. Your contract for the sale is with them; Creativity is not a party to it. The invoice is issued in the seller’s name and is available from your library.
A rental gives you access for the stated number of hours. The clock starts when the rental is granted — that is, when you pay — not when you first press play. A purchase gives you access for as long as the title remains available on this platform; if a partner later withdraws a title, purchases already made keep working.
Any Creativity+ member discount is applied at the moment you pay and is never recalculated afterwards. If your membership later ends, what you already bought is unaffected.
Access is personal to your account and to the countries where the seller has made the title available. You may not share, resell or redistribute a title or any stream from it.
Your 14-day right to cancel
If you buy as a consumer, you have a legal right to cancel a contract for digital content within 14 days of the purchase without giving a reason (Directive 2011/83/EU on consumer rights; for buyers in the United Kingdom, the Consumer Contracts Regulations 2013).
Access to a title begins the moment your payment succeeds. For that reason, before you pay we ask you to tick a box confirming two things: that you ask for access to begin immediately, and that you understand that once you start watching you lose the right to cancel. That confirmation is recorded with your order, and without it a purchase cannot be completed.
Until you first press play, the right remains yours in full: cancel within 14 days and the seller refunds the whole price. Once playback has started, the right is lost and any refund is at the seller’s discretion — the refund policy explains how we handle that in practice.
The right is exercised against the seller, the partner named on your invoice. To exercise it, use the refund form in your library or write to the contact address on this page, quoting your order reference and stating that you wish to cancel. No particular form of words is needed. Creativity passes the request to the seller and handles the paperwork on your behalf; the refund is returned to the payment method you used.
Your rights if a title is faulty
A seller must supply digital content that matches its description and works as it should. If it does not — the title will not play, plays broken, or is not what was described — you are entitled, under Directive (EU) 2019/770 on digital content and, for buyers in the United Kingdom, the Consumer Rights Act 2015, to have it put right; and if that is not possible within a reasonable time, to a price reduction or to end the contract and receive a refund.
These rights are against the seller and cannot be signed away. Creativity operates the streaming, so in practice you tell us, we fix what is ours to fix, and we obtain the refund from the seller where one is due.
The platform is provided as it is
The whole platform — Creativity’s own catalogue, the site, the television and casting apps and every feature of them — is provided “as is” and “as available”, without any warranty, express or implied. We give no guarantee that a particular title will stay available, that the service will be uninterrupted, secure or error-free, or that it is fit for any particular purpose. We may add, change, suspend or remove free content and features at any time, without notice.
This does not affect anything you have paid for, which is covered by the sections above and by the seller’s own obligations.
Limits on our liability
Creativity provides the platform: hosting, streaming, your account, your entitlements and support. Those are the things we are responsible for, and we provide them with reasonable care and skill.
We are not responsible for the content of partner titles, for the sale of a partner title, or for the seller’s obligations. Those sit with the partner as seller, and your statutory rights against the seller are not limited by these terms.
Subject to the section below, our total liability to you arising out of or in connection with the platform in any twelve-month period is limited to the greater of (a) £100 and (b) the total you paid for titles on the platform in that period. We are not liable for any loss that was not a foreseeable result of our breaking these terms, for loss of profit, business or opportunity, or for loss caused by events outside our reasonable control — including failures of the internet, of your device, or of a third-party service such as YouTube, Google or Stripe.
If defective digital content we supplied damages your device or other digital content you own, and we failed to use reasonable care and skill, we will repair the damage or compensate you, as the law requires.
Creativity is a brand name, not a company or other legal entity. The platform is run by Thomas Doykinitsas, an individual trading as a sole trader, and every limit and exclusion in these terms applies to that individual. Nothing on this page is a promise of any liability greater than the law imposes, and to the extent the law allows you use the platform at your own risk.
Liability we do not exclude, and severability
Nothing in these terms excludes or limits any liability that cannot lawfully be excluded or limited. That includes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, and any other liability the applicable law does not permit to be excluded.
Nothing in these terms affects your rights as a consumer under mandatory law, including your statutory rights against the seller of a paid title.
If any part of these terms is found to be unlawful, invalid or unenforceable, that part is to be read down to the minimum extent necessary — or removed, if it cannot be — and the rest of these terms continue in force.
Who you are dealing with
These terms are between you and the trader named below. “Creativity” is the brand the platform is operated under, not a legal person: it cannot be contracted with, sued or written to, so business and legal correspondence must be addressed to the trader named here, at the contact details shown.
